 Do both parties have to agree to a divorce? Okay this is a really silly question. I just watched Sweet Home Alabama and I was just wondering. Do both parties need to consent for a divorce to happen? Like in the real world, could a girl really not divorce a guy simply because he would not sign the papers?

| U don't have 2 have the other person. There's a statute of limitations that after a certain amoun of time like 60-90 days the divorce will b final regardless if the other person signs the papers or not.

| It'd be considered contested and would create a little more legal work along with some extra time and money. But it could be finalized without the others consent. Its just a bit more difficult and the procedures differ from state to state.
